fran\u00e7aise qui vise \u00e0 simplifier et harmoniser le processus d'indemnisation et de gestion des sinistres dans les immeubles collectifs (comme les copropri\u00e9t\u00e9s). <\/span>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3380847 elementor-widget elementor-widget-text-editor\" data-id=\"3380847\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La <strong>majorit\u00e9<\/strong> des <strong>recours<\/strong> concerne le sinistre le plus fr\u00e9quent et le plus r\u00e9pandu dans les <strong>immeubles<\/strong>, c&rsquo;est-\u00e0-dire le <strong>d\u00e9g\u00e2t des eaux<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-46b7490d elementor-widget elementor-widget-heading\" data-id=\"46b7490d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Recours pour les sinistres de Tranche 1<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1981b0a0 elementor-widget elementor-widget-heading\" data-id=\"1981b0a0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Principe<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour les <b>sinistres <\/b>de <b>Tranche 1<\/b>, les soci\u00e9t\u00e9s <b>renoncent <\/b>entre elles \u00e0 exercer un <b>recours <\/b>pour :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e235fff elementor-widget elementor-widget-text-editor\" data-id=\"e235fff\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Les dommages mat\u00e9riels et les frais aff\u00e9rents dont le montant est inf\u00e9rieur \u00e0 1 600 \u20ac HT.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3a7d40c elementor-widget elementor-widget-text-editor\" data-id=\"3a7d40c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Y compris pour la valeur \u00e0 neuf r\u00e9gl\u00e9e au titre des <strong><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quest-ce-qui-est-considere-comme-des-embellisements-dans-le-cadre-dun-degat-des-eaux-dde\/\">embellissements<\/a><\/strong> et des <strong><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/gerer-un-litige-lors-dun-degat-des-eaux\/dommages-aux-parties-immobilieres-privatives-pip-cest-quoi\/\">PIP<\/a><\/strong>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba7f00 elementor-widget elementor-widget-heading\" data-id=\"ba7f00\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Exception : les sinistres r\u00e9p\u00e9titifs<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f97a380 elementor-widget elementor-widget-text-editor\" data-id=\"f97a380\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>L&rsquo;assureur gestionnaire peut <b>d\u00e9clencher<\/b> un <b>recours <\/b>\u00e0 partir du <b>2\u00e8me sinistre<\/b>, si les conditions suivantes sont r\u00e9unies :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6a65393 elementor-widget elementor-widget-text-editor\" data-id=\"6a65393\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Moins de 24 mois entre les 2 \u00e9v\u00e8nements.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-879f6cd elementor-widget elementor-widget-text-editor\" data-id=\"879f6cd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>M\u00eame auteur au sens du bar\u00e8me conventionnel (voir <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lintegralite-de-la-convention-irsi-en-pdf\/\"><b>tableau du bar\u00e8me de r\u00e9partition en ANNEXE de la convention IRSI<\/b><\/a>).<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-495ffce elementor-widget elementor-widget-text-editor\" data-id=\"495ffce\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Que la cause soit identique ou diff\u00e9rente.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a584ecd elementor-widget class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>Quelles que soient les modalit\u00e9s de gestion du sinistre pr\u00e9c\u00e9dent (convention ou hors convention).<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9c07383 elementor-widget elementor-widget-text-editor\" data-id=\"9c07383\" a pu survenir avant l&rsquo;entr\u00e9e en vigueur de la convention IRSI (1er juin 2018).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-572d2606 class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Un premier sinistre DDE survenu le 18 mars 2017 ayant pour origine un d\u00e9bordement d&rsquo;appareil \u00e0 effet d&rsquo;eau. Un deuxi\u00e8me sinistre survenu le 25 ao\u00fbt 2018 ayant pour origine une fuite sur un joint de robinetterie.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1bb2b50 elementor-widget elementor-widget-text-editor\" data-id=\"1bb2b50\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Selon le bar\u00e8me de l&rsquo;ANNEXE 1 (Bar\u00e8me de r\u00e9partition) de l&rsquo;IRSI, ces 2 origines, certes diff\u00e9rentes, engagent cependant la responsabilit\u00e9 de l&rsquo;occupant. Un recours pourra \u00eatre pr\u00e9sent\u00e9 pour le 2\u00e8me sinistre aupr\u00e8s de l&rsquo;assureur de l&rsquo;occupant du 2\u00e8me sinistre m\u00eame si le montant des dommages est inf\u00e9rieur \u00e0 1 600 \u20ac HT.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a0d271 elementor-widget elementor-widget-text-editor\" data-id=\"1a0d271\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Dans le cadre des sinistres r\u00e9p\u00e9titifs l&rsquo;assureur exerce son recours :<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-652aa1c elementor-widget elementor-widget-text-editor\" data-id=\"652aa1c\" href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lintegralite-de-la-convention-irsi-en-pdf\/\">nnexe 1 de la convention IRSI<\/a><\/b>.<\/p><p><img class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Principe<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour les <b>sinistres <\/b>de <b>Tranche 2<\/b>, l&rsquo;assureur peut, apr\u00e8s <b>indemnisation<\/b>, exercer un <b>recours <\/b>\u00e0 l&rsquo;encontre de <b>l&rsquo;assureur conventionnellement<\/b> d\u00e9sign\u00e9 en application du bar\u00e8me figurant en annexe 1.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6bfb20 elementor-widget elementor-widget-text-editor\" data-id=\"a6bfb20\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Les <b>indemnit\u00e9s <\/b>vers\u00e9es au titre des <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/la-determination-de-la-tranche-dans-la-convention-irsi\/\">dommages mat\u00e9riels<\/a><\/b> et des <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/la-determination-de-la-tranche-dans-la-convention-irsi\/\">frais aff\u00e9rents<\/a><\/b> donnent <b>droit \u00e0 recours<\/b>, <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/vetuste-deduite-dans-le-cadre-de-la-convention-irsi-explications\/\">v\u00e9tust\u00e9 d\u00e9duite<\/a><\/b>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93a0544 elementor-widget elementor-widget-heading\" data-id=\"93a0544\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Pourquoi le recours est pr\u00e9sent\u00e9 hors valeur \u00e0 neuf ?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-db1ad84 elementor-widget elementor-widget-text-editor\" data-id=\"db1ad84\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La convention 3.1 du recueil de la FFA (F\u00e9d\u00e9ration Fran\u00e7aise des Assurances) pr\u00e9voit que : \u00ab\u00a0les soci\u00e9t\u00e9s qui interviennent en assurance de choses, renoncent \u00e0 exercer un recours contre les assureurs de responsabilit\u00e9 et ce quelle que soit la cat\u00e9gorie de responsabilit\u00e9 civile concern\u00e9e (RC exploitation, chef d&rsquo;entreprise, commune, auto, chef de famille&#8230;) pour la <b>Valeur\u00a0<\/b><span style=\"color: #1f1f1f; font-family: (impossibilit\u00e9 pour un locataire d&rsquo;occuper partiellement ou totalement son logement), non pr\u00e9vu dans la liste des dommages immat\u00e9riels ouvrant droit \u00e0 son recours dans le
