IRSI, CIDE COP ne sont pas applicables.<\/span>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f1cb4e4 elementor-widget elementor-widget-text-editor\" data-id=\"7f1cb4e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Nous avons vu pr\u00e9c\u00e9demment que la <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/guide-de-survie-en-copropriete\/la-convention-irsi-quest-ce-que-cest\/\"><b>convention IRSI<\/b><\/a> s&rsquo;appliquait notamment dans des immeubles en copropri\u00e9t\u00e9 tant que le montant des dommages mat\u00e9riels et frais aff\u00e9rents dans un local sinistr\u00e9 \u00e9tait inf\u00e9rieur \u00e0 5 000 \u20ac.<\/p>\n<p>Au-del\u00e0 de ce montant c&rsquo;est la <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/guide-de-survie-en-copropriete\/la-convention-cide-cop\/\"><b>convention CIDE COP<\/b><\/a> qui trouvera son application.<\/p>\n<p>Mais, la convention CIDE COP ne s&rsquo;applique qu&rsquo;\u00e0 condition que le DDE prenne naissance dans la copropri\u00e9t\u00e9 concern\u00e9e.<\/p>\n<p>Donc, \u00e0 partir du moment o\u00f9 le montant des dommages dans un local sinistr\u00e9 est sup\u00e9rieur \u00e0 5 000 \u20ac <b>mais avec une origine dans l&rsquo;immeuble voisin ou mitoyen de la copropri\u00e9t\u00e9 c&rsquo;est cette convention 2.1 qui s&rsquo;appliquera<\/b>.<\/p>\n<p>Vous constaterez de nombreuses similitudes entre la convention CIDE COP et la convention 2.1.<\/p>\n<p>Retrouvez notre <b><a class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En effet, cette convention s&rsquo;applique aux <b>contrats d&rsquo;assurances<\/b> de choses mis en jeu pour <b>l&rsquo;indemnisation <\/b>des dommages aux <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/gerer-un-litige-lors-dun-degat-des-eaux\/dommages-aux-parties-immobilieres-privatives-pip-cest-quoi\/\">parties immobili\u00e8res<\/a><\/b> et aux <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quest-ce-qui-est-considere-comme-des-embellisements-dans-le-cadre-dun-degat-des-eaux-dde\/\">embellissements<\/a><\/b> d&rsquo;une copropri\u00e9t\u00e9.<\/p><p>Pour l&rsquo;application de la convention, il convient d&rsquo;admettre :<\/p><ul><li>Tout <b>contrat <\/b>de <b>copropri\u00e9taire occupant<\/b>, de <b>locataire <\/b>ou de tout autre <b>occupant <\/b>est <b>r\u00e9put\u00e9 garantir<\/b>, au titre et dans la limite des biens <b>mobiliers<\/b> : les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quest-ce-qui-est-considere-comme-des-embellisements-dans-le-cadre-dun-degat-des-eaux-dde\/\">embellissements<\/a><\/b><\/li><li>Tout <b>contrat <\/b>souscrit par la <b>copropri\u00e9t\u00e9 <\/b>est <b>r\u00e9put\u00e9 garantir<\/b>, au titre et dans la limite des biens immobiliers : les parties <b>immobili\u00e8res class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cette convention apporte une solution au <b>cumul d&rsquo;assurances de choses<\/b> entre le contrat de la copropri\u00e9t\u00e9 (<a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lassurance-multirisque-immeuble-mri\/\"><b>MRI<\/b><\/a>) et les contrats souscrits individuellement par les occupants (<a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/lassurance-multirisque-habitation-mrh\/\"><b>MRH<\/b><\/a>) pour les sinistres survenant dans les immeubles en copropri\u00e9t\u00e9, en mati\u00e8re d&rsquo;incendie et risques divers.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c35194 elementor-widget elementor-widget-text-editor\" data-id=\"8c35194\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Elle ne <b>d\u00e9roge <\/b>pas, aux <b>dispositions <\/b>des <b>contrats <\/b>en pr\u00e9sence tant en ce qui <b>concerne <\/b>:<\/p><ul><li>Les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/que-sont-les-evenements-garantis-dans-le-cadre-dun-degat-des-eaux-dde\/\">\u00e9v\u00e8nements garantis<\/a><\/b><\/li><li>Les <b>biens assur\u00e9s<\/b><\/li><li>Les <b>garanties accord\u00e9es <\/b>et leur <b>montant<\/b><\/li><li>Les <b>modalit\u00e9s d&rsquo;indemnisation <\/b>(application des <b>franchises<\/b>, des <b>r\u00e8gles proportionnelles <\/b>de primes ou de <b>capitaux<\/b>&#8230;)<\/li><\/ul><div>\u00a0<\/div><div><p>Les <b>indemnit\u00e9s <\/b>\u00e9ventuellement dues au titre des <b>garanties <\/b>(recherche de fuites) <b>n&rsquo;entrent pas <\/b>dans le champ d&rsquo;application de la <b>convention<\/b>.<\/p><p>En cas de <b>cumul <\/b>d&rsquo;assurances entre plusieurs assurances <b>garantissant <\/b>ces frais de recherche de fuites, il convient d&rsquo;appliquer les <b>r\u00e8gles <\/b>concernant les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/les-assurances-cumulatives-quest-ce-que-cest\/\">assurances cumulatives<\/a> <\/b>: les <b>assureurs <\/b>dans la cadre des assurances cumulatives <b>contribuent <\/b>\u00e0 la <b>prise en charge<\/b> des frais de recherche de fuite selon les <b>dispositions <\/b>de leur <b>contrat respectif<\/b>.<\/p><\/div><div>A la <b>diff\u00e9rence <\/b>de la <b>CIDE COP<\/b>, les <b>recours <\/b>en <b>responsabilit\u00e9 <\/b>ne sont pas <b>conventionnels <\/b>mais doivent s&rsquo;exercer selon les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/degat-des-eaux-dde-quelles-sont-les-regles-de-droit-commun\/\">r\u00e8gles de droit commun<\/a><\/b>.\u00a0<\/div>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3579290a elementor-widget elementor-widget-heading\" data-id=\"3579290a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 Le champ d'application<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a0f62dd elementor-widget elementor-widget-text-editor\" data-id=\"a0f62dd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><b>2 types <\/b>d&rsquo;ensembles <b>immobiliers <\/b>sont concern\u00e9s par cette <b>convention <\/b>:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5b8da4a2 elementor-widget elementor-widget-heading\" data-id=\"5b8da4a2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1 - Les immeubles en copropri\u00e9t\u00e9 verticale et les SCI :<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6df6de6c elementor-widget elementor-widget-text-editor\" data-id=\"6df6de6c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Les r\u00e8gles pour l&rsquo;indemnisation des dommages, aux <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quest-ce-qui-est-considere-comme-des-embellisements-dans-le-cadre-dun-degat-des-eaux-dde\/\">embellissements<\/a>, parties immobili\u00e8res privatives et parties communes s&rsquo;appliquent.<\/p><p>Pour l&rsquo;application de la convention, on entend par :<\/p><ul><li><strong>Immeuble en copropri\u00e9t\u00e9<\/strong> : les propri\u00e9t\u00e9s r\u00e9parties entre plusieurs personnes par lots comprenant chacune une partie privative et une quote-part des parties communes.<\/li><li>Les <strong>immeubles appartenant aux SCI<\/strong> (soci\u00e9t\u00e9s civiles immobili\u00e8res) dont les associ\u00e9s ont la jouissance des appartements ou lots correspondant \u00e0 leurs parts sociales.\u00a0<\/li><\/ul><p>On entend donc, au sens de cette convention par :<\/p><ul><li><strong>Copropri\u00e9t\u00e9<\/strong> : la copropri\u00e9t\u00e9 ou la soci\u00e9t\u00e9 civile immobili\u00e8re (SCI)<\/li><li><strong>Copropri\u00e9taires<\/strong> : les copropri\u00e9taires ou les associ\u00e9s de SCI<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df8b3fc elementor-widget elementor-widget-heading\" data-id=\"df8b3fc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2- Les ensembles de pavillons, maisons<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-414d85b4 elementor-widget elementor-widget-text-editor\" data-id=\"414d85b4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour lesquels la <b>division <\/b>en <b>lots <\/b>n&rsquo;est g\u00e9n\u00e9ralement pas <b>homog\u00e8ne <\/b>et qui se <b>distinguent <\/b>de la <b>copropri\u00e9t\u00e9 classique <\/b>par leur r\u00e9gime d&rsquo;appropriation du <b>sol <\/b>puisque ces ensembles comportent une <b>partie privative <\/b>(le <b>pavillon <\/b>et le <b>terrain <\/b>sur lequel il est construit, par exemple) faisant l&rsquo;objet de droit de\u00a0 <b>propri\u00e9t\u00e9s privatifs<\/b>, \u00e0 c\u00f4t\u00e9 de <b>terrains<\/b>, <b>am\u00e9nagements <\/b>ou services \u00e0 <b>usage collectif<\/b>.<\/p><p>La convention <b>ne s&rsquo;applique pas<\/b> pour la <b>prise en charge<\/b> des <b>dommages <\/b>aux <b>embellissements <\/b>et aux <b>parties immobili\u00e8res privatives <\/b>de ce <b>type <\/b>d&rsquo;ensembles immobiliers.<\/p><p>La pr\u00e9sente convention <b>s&rsquo;applique uniquement <\/b>pour <b>l&rsquo;indemnisation <\/b>des <b>dommages <\/b>aux parties <b>communes <\/b>de ces <b>ensembles<\/b>.<\/p><p>Seuls les <b>embellissements <\/b>et les <b>parties immobili\u00e8res<\/b> sont <b>concern\u00e9s <\/b>par cette <b>convention<\/b>.\u00a0<\/p><p>Les embellissements et les parties immobili\u00e8res privatives d&rsquo;un immeuble en copropri\u00e9t\u00e9, garantis \u00e0 la fois par :<\/p><ul><li>Le contrat d&rsquo;assurance souscrit par la copropri\u00e9t\u00e9 (<strong><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lassurance-multirisque-immeuble-mri\/\">MRI<\/a><\/strong>)<\/li><li>Le contrat d&rsquo;assurance souscrit personnellement par le copropri\u00e9taire (<b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/lassurance-multirisque-habitation-mrh\/\">MRH<\/a><\/b>), le locataire ou tout autre occupant d\u00e8s lors que ce contrat couvre le b\u00e2timent et\/ou le mobilier.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2953df elementor-widget elementor-widget-text-editor\" data-id=\"b2953df\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Cette convention ne vise que :<\/p><ul><li>Les <b>locaux <\/b>\u00e0 <b>usage d&rsquo;habitation<\/b><\/li><li>Les <b>locaux <\/b>\u00e0 <b>usage mixte<\/b> \u00e0 condition que :<ul><li>Le <b>sinistre <\/b>prenne <b>naissance <\/b>dans la <b>partie <\/b>des <b>locaux <\/b>\u00e0 usage <b>d&rsquo;habitation<\/b> ou dans les parties <b>communes <\/b>de l&rsquo;immeuble<\/li><li>Et <b>n&rsquo;affecte pas <\/b>les parties \u00e0 usage <b>professionnel<\/b><\/li><\/ul><\/li><li>Les <b>locaux <\/b>\u00e0 usage <b>professionnel <\/b>sont <b>exclus <\/b>de cette <b>convention<\/b>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a8aa502 elementor-widget elementor-widget-text-editor\" data-id=\"a8aa502\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Pour information, <b>entrent <\/b>dans le <b>champ d&rsquo;application <\/b>de la pr\u00e9sente convention, les <b>sinistres <\/b>caus\u00e9s par l&rsquo;un des <b>\u00e9v\u00e8nements suivants <\/b>:<\/p><ul><li>Incendie, explosion, foudre et risques annexes (temp\u00eates, gr\u00eale, neige, catastrophes naturelles, choc de v\u00e9hicules, attentats,&#8230;)<\/li><li>Bris de glace<\/li><li>D\u00e9g\u00e2t des eaux (lorsque les <b>conventions <a
