Nous allons voir les <b>2 situations <\/b>o\u00f9 la convention CIDE COP s&rsquo;applique en lieu et place de l&rsquo;IRSI :<\/p><ul><li>Lorsque le <b>montant des dommages<\/b> dans un local sinistr\u00e9 est <b>sup\u00e9rieur <\/b>au plafond d&rsquo;application de l&rsquo;IRSI (<b>sup\u00e9rieur \u00e0 5 000 \u20ac<\/b>)<\/li><li>Ou lorsque les dommages sont <b>inf\u00e9rieurs \u00e0 5 000 \u20ac<\/b> mais que la <b>cause<\/b> du DDE est <b>exclue de l&rsquo;IRSI<\/b> mais <b>garantie <\/b>au titre du contrat : par exemple, <b>infiltrations <\/b>par le mur de <b>fa\u00e7ade<\/b> (cause exclue en IRSI) de la copropri\u00e9t\u00e9 occasionnant des <b>dommages <\/b>(dont le montant s&rsquo;\u00e9l\u00e8ve \u00e0 3 000 \u20ac) dans l&rsquo;appartement d&rsquo;un copropri\u00e9taire occupant dont le contrat MRH garantit en DDE les infiltrations par le mur de fa\u00e7ade.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e960187 elementor-widget elementor-widget-heading\" data-id=\"4e960187\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Les objectifs de la CIDE COP<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-20bef9e2 elementor-widget elementor-widget-text-editor\" data-id=\"20bef9e2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La convention CIDE COP a 3 objectifs :<\/p><ul><li><b>Am\u00e9liorer<\/b>, pour les assur\u00e9s, les d\u00e9lais de r\u00e8glement des sinistres d\u00e9g\u00e2ts des eaux hors convention IRSI (en particulier ceux sup\u00e9rieurs \u00e0 5 000 \u20ac HT) dans une copropri\u00e9t\u00e9.<\/li><li><b>Simplifier <\/b>les relations entre assureurs, et ce quelle que soit la qualit\u00e9 des parties en cause : collectivit\u00e9, copropri\u00e9taire non occupant, copropri\u00e9taire occupant, locataire, tout autre occupant.<\/li><li><b>R\u00e9gler <\/b>les probl\u00e8mes de <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/les-assurances-cumulatives-quest-ce-que-cest\/\"><b>cumul d&rsquo;assurances<\/b><\/a> existants dans les immeubles en copropri\u00e9t\u00e9 du fait de la pr\u00e9sence du contrat de la copropri\u00e9t\u00e9 (<a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lassurance-multirisque-immeuble-mri\/\"><b>MRI : Multirisque Immeuble<\/b><\/a>) et des contrats des occupants, copropri\u00e9taires et locataires (<a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/lassurance-multirisque-habitation-mrh\/\"><b>MRH : Multirisque Habitation<\/b><\/a>) :<ul><li>\u00a0Tant en assurance de choses : en d\u00e9signant l&rsquo;assureur conventionnellement r\u00e9put\u00e9 pour prendre en charge les dommages, selon la nature des dommages<\/li><li>Qu&rsquo;en assurance de responsabilit\u00e9 : en d\u00e9signant l&rsquo;assureur conventionnellement responsable<\/li><\/ul><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-639b4974 elementor-widget elementor-widget-heading\" data-id=\"639b4974\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Le champ d'application<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4a67959f class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">La convention CIDE COP s'applique :<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/15.0.3\/svg\/2b50.svg\" alt=\"\u2b50\" \/> Aux <b>sinistres <\/b>d\u00e9g\u00e2ts des eaux survenus dans un <b>immeuble en copropri\u00e9t\u00e9<\/b> situ\u00e9 en France m\u00e9tropolitaine, dans un d\u00e9partement d&rsquo;Outre-mer ou en Principaut\u00e9 de Monaco dont l&rsquo;origine du d\u00e9g\u00e2t des eaux se situe dans cet immeuble<\/p><p><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/15.0.3\/svg\/2b50.svg\" alt=\"\u2b50\" \/> Mettant en cause <b>au moins 2 soci\u00e9t\u00e9s d&rsquo;assurances adh\u00e9rentes<\/b> (assureur copropri\u00e9taire &#8211; assureur collectivit\u00e9 &#8211; assureur locataire) couvrant chacune le risque d\u00e9g\u00e2ts des eaux en assurance de choses et\/ou de responsabilit\u00e9.<\/p><p><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/15.0.3\/svg\/2b50.svg\" alt=\"\u2b50\" \/> Entra\u00eenant des <b>dommages aux embellissements \/am\u00e9nagements<\/b>, et\/ou au <b>mobilier<\/b>, et\/ou aux <b>parties immobili\u00e8res privatives <\/b>ou <b>communes<\/b>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-54087594 elementor-widget elementor-widget-heading\" data-id=\"54087594\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div :<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7de68a1 elementor-widget elementor-widget-heading\" data-id=\"7de68a1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Les 2 exceptions aux limit\u00e9s d'application :<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-495ec02e elementor-widget elementor-widget-text-editor\" dispositions des contrats en pr\u00e9sence, tant en ce qui concerne les <b>\u00e9v\u00e8nements garantis<\/b>, les <b>biens assur\u00e9s<\/b>, les <b>garanties accord\u00e9es<\/b> et leur <b>montant<\/b>, les <b>modalit\u00e9s <\/b>d&rsquo;indemnisation (c&rsquo;est \u00e0 dire l&rsquo;application des franchises, des <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/regles-proportionnelles-de-primes-cest-quoi\/\">r\u00e8gles proportionnelles de primes<\/a><\/b> ou de capitaux&#8230;)<\/p><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-891c83e elementor-widget elementor-widget-text-editor\" data-id=\"891c83e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2b50.svg\" alt=\"\u2b50\" \/> La convention CIDE COP ne <b>s&rsquo;applique<\/b>, pour chaque assureur intervenant au titre d&rsquo;une assurance <b>de choses<\/b> ou au titre d&rsquo;une assurance de <b>responsabilit\u00e9<\/b>, que si sa garantie est acquise et dans la limite de cette garantie.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-250b9cf5 e-flex e-con-boxed e-con e-child\" class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Un copropri\u00e9taire occupant d\u00e9clare \u00e0 son assureur des dommages dans son appartement dont la cause est une infiltration par la fa\u00e7ade de l&rsquo;immeuble.\u00a0<\/strong><\/p><p><strong>Si le contrat MRH (Multirisques Habitation) de ce copropri\u00e9taire pr\u00e9voit, dans les circonstances r\u00e9put\u00e9es garanties au titre du d\u00e9g\u00e2t des eaux que les infiltrations par fa\u00e7ade sont couvertes, son assureur ouvrira un dossier sinistre au titre de la CIDE COP :\u00a0<\/strong><\/p><p><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/> Si le contrat de la copropri\u00e9t\u00e9 pr\u00e9voit \u00e9galement la garantie des infiltrations par la fa\u00e7ade, il fera proc\u00e9der \u00e0 une expertise amiable et contradictoire (avec convocation de l&rsquo;assureur de la copropri\u00e9t\u00e9 aux op\u00e9rations d&rsquo;expertise) indemnisera son assur\u00e9 selon les dispositions de la convention (voir section sur les r\u00e8gles de prise en charge) et exercera un recours conventionnel aupr\u00e8s de l&rsquo;assureur de la copropri\u00e9t\u00e9, s&rsquo;agissant d&rsquo;une origine immeuble.<\/strong><\/p><p><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/> Si le contrat d&rsquo;assurance de la copropri\u00e9t\u00e9 ne pr\u00e9voit pas la garantie des infiltrations par fa\u00e7ade, l&rsquo;assureur MRH du copropri\u00e9taire l\u00e9s\u00e9, indemnisera son assur\u00e9 dans la limite du contrat et sans possibilit\u00e9 de recours.<\/strong><\/p><p><strong><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/>\u00a0Si le contrat MRH ne pr\u00e9voit pas les infiltrations par la fa\u00e7ade, l&rsquo;assureur MRH n&rsquo;est pas tenu d&rsquo;intervenir ni au titre de la convention, ni au titre du contrat. Le copropri\u00e9taire l\u00e9s\u00e9 devra faire son affaire personnelle de son recours aupr\u00e8s de l&rsquo;assureur de l&rsquo;immeuble.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aef8daf elementor-widget elementor-widget-text-editor\" data-id=\"aef8daf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Toutefois, il existe <b>2 exceptions<\/b> aux <b>limites d&rsquo;application <\/b>:<\/p><ul><li>Les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quest-ce-qui-est-considere-comme-des-embellisements-dans-le-cadre-dun-degat-des-eaux-dde\/\">embellissements<\/a> <\/b>d\u00e9finis conventionnellement sont r\u00e9put\u00e9s assur\u00e9s au titre et dans la limite des biens mobiliers de l&rsquo;occupant (m\u00eame si le contrat d&rsquo;assurance des occupants : copropri\u00e9taire ou locataire pr\u00e9voit une d\u00e9finition diff\u00e9rente des embellissements que celle donn\u00e9e par la CIDE COP (voir section Les embellissements)<\/li><li>Les <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/gerer-un-litige-lors-dun-degat-des-eaux\/dommages-aux-parties-immobilieres-privatives-pip-cest-quoi\/\">parties immobili\u00e8res privatives<\/a><\/b> d\u00e9finies conventionnellement sont r\u00e9put\u00e9es assur\u00e9es au titre et dans la limite de la garantie des biens immobiliers du contrat de l&rsquo;immeuble : le contrat de l&rsquo;immeuble est donc, de fait r\u00e9put\u00e9 garantir tant les <b>parties communes<\/b> que les <b>parties immobili\u00e8res privatives<\/b>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4ff5234a elementor-widget elementor-widget-heading\" data-id=\"4ff5234a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Les exclusions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4388f8b8 elementor-widget elementor-widget-text-editor\" data-id=\"4388f8b8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Sont <b>exclus <\/b>de la convention CIDE COP, les sinistres :<\/p>\n<p><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/274c.svg\" alt=\"\u274c\"> Entrant dans le <b>champ d&rsquo;application de l&rsquo;IRSI<\/b><\/p>\n<p><img decoding=\"async\"
