D\u00e9couvrez comment r\u00e9agir et quelles sont les responsabilit\u00e9s de chaque partie lors d\u2019un sinistre en copropri\u00e9t\u00e9.<\/em><\/span>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-176a5107 elementor-widget elementor-widget-heading\" data-id=\"176a5107\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Qui doit \u00eatre assur\u00e9\u2009?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-53e38799 elementor-widget elementor-widget-text-editor\" data-id=\"53e38799\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><\/p>\n<p class=\"wp-block-paragraph\">Chaque <b>habitant <\/b>de la copropri\u00e9t\u00e9 a un statut et cela d\u00e9termine le type d\u2019assurance habitation que chacun doit souscrire :<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\"><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/> Le <b>locataire <\/b>doit imp\u00e9rativement <b>prot\u00e9ger <\/b>le logement lou\u00e9 par une garantie \u00ab\u2009d\u00e9g\u00e2t des eaux\u2009\u00bb (sauf en cas de location saisonni\u00e8re).<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\"><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/> Le <b>propri\u00e9taire occupant<\/b> a l\u2019obligation de s\u2019assurer en <b>responsabilit\u00e9 civile <\/b>pour couvrir tous les <b>dommages <\/b>qui trouvent leur <b>origine <\/b>dans son logement. Il n\u2019y a pas d\u2019obligation l\u00e9gale pour la garantie \u00ab\u2009d\u00e9g\u00e2t des eaux\u2009\u00bb, mais les <b>r\u00e8glements <\/b>de copropri\u00e9t\u00e9 l\u2019imposent assez souvent.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\"><img decoding=\"async\" class=\"emoji\" role=\"img\" draggable=\"false\" src=\"https:\/\/s.w.org\/images\/core\/emoji\/14.0.0\/svg\/2705.svg\" alt=\"\u2705\" \/> Depuis la loi <b>Allur <\/b>de 2014, <b>l&rsquo;assurance <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/lassurance-pno-proprietaire-non-occupant\/\">PNO<\/a> (propri\u00e9taire non occupant)<\/b> est <b>obligatoire <\/b>seulement pour les <b>propri\u00e9taires <\/b>de biens immobiliers en <b>copropri\u00e9t\u00e9<\/b>. L&rsquo;assurance <b>PNO <\/b>est obligatoire que le logement soit <b>occup\u00e9 <\/b>ou <b>vacant<\/b>, <b>vide <\/b>ou <b>meubl\u00e9<\/b>. Cette assurance sp\u00e9cifique couvre le <b>bailleur <\/b>en cas de <b>vacance <\/b>locative ou <b>d\u2019absence <\/b>d\u2019assurance du locataire.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Peu importe la <b>situation<\/b>, il est conseill\u00e9 de vous <b>reporter <\/b>au r\u00e8glement de <b>copropri\u00e9t\u00e9 <\/b>pour conna\u00eetre toutes les modalit\u00e9s d\u2019assurance qui s\u2019appliquent \u00e0 votre <b>immeuble<\/b>.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Il est \u00e0 noter que depuis la loi <b>Alur <\/b>de 2014, celle-ci impose \u00e0 chaque immeuble en <b>copropri\u00e9t\u00e9 <\/b>d\u2019\u00eatre assur\u00e9 par une couverture <b>collective<\/b>, \u00e0 minima pour la <b>responsabilit\u00e9 civile<\/b>.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Cela permet <b>d\u2019indemniser <\/b>les victimes des dommages <b>mat\u00e9riels <\/b>ou <b>corporels <\/b>engendr\u00e9s par un \u00e9l\u00e9ment des parties communes de l\u2019immeuble (escaliers glissants, tuiles qui tombent du toit&#8230;).<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Le <b>syndic <\/b>dans son r\u00f4le de repr\u00e9sentant <b>l\u00e9gal <\/b>du syndicat des copropri\u00e9taires, a pour devoir de souscrire une <b>assurance responsabilit\u00e9 civile copropri\u00e9t\u00e9<\/b>.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Attention tout de m\u00eame ce contrat de couvre pas les d\u00e9g\u00e2ts des eaux dans l\u2019immeuble.<\/p>\n<p> <\/p>\n<p class=\"wp-block-paragraph\">Pour b\u00e9n\u00e9ficier d\u2019une garantie \u00ab\u2009<b>d\u00e9g\u00e2t des eaux<\/b>\u2009\u00bb pour les parties communes, le syndic peut souscrire une assurance <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/lassurance-multirisque-immeuble-mri\/\">multirisque immeuble (MRI)<\/a><\/b>. Facultative, elle doit \u00eatre soumise au vote de<b> l\u2019assembl\u00e9e g\u00e9n\u00e9rale<\/b>.<\/p>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-705db4cc elementor-widget elementor-widget-heading\" data-id=\"705db4cc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Quel est le r\u00f4le de l\u2019assurance dans les d\u00e9g\u00e2ts des eaux en copropri\u00e9t\u00e9\u2009?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5447cbd5 elementor-widget elementor-widget-text-editor\" data-id=\"5447cbd5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Il est <b>obligatoire <\/b>que toutes les personnes impliqu\u00e9es <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-avec-mon-assureur\/quand-et-comment-declarer-son-sinitre-de-degat-des-eaux\/\"><b>d\u00e9clarent le d\u00e9g\u00e2t des eaux<\/b><\/a> \u00e0 leur assureur, peu importe l\u2019origine de la fuite et le responsable du sinistre.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-19631a3a elementor-widget elementor-widget-heading\" data-id=\"19631a3a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Dans le cas o\u00f9 le d\u00e9g\u00e2t concerne uniquement les parties communes<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b437f elementor-widget elementor-widget-text-editor\" data-id=\"1b437f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Un d\u00e9g\u00e2t des eaux peut survenir dans les <b>parties communes<\/b> de l&rsquo;immeuble et n&rsquo;affecter que les parties communes : <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-sinistre-de-degat-des-eaux\/degat-des-eaux-au-plafond-quoi-faire\/\"><b>plafond du couloir<\/b><\/a>, mur de la <b>cage d\u2019escalier<\/b>, <b>cour <\/b>int\u00e9rieure&#8230;<\/p>\n<p>   <\/p>\n<p>Le syndic doit <b>d\u00e9clarer <\/b>le sinistre \u00e0 la compagnie d\u2019assurance de <b>copropri\u00e9t\u00e9<\/b>. Celle-ci prendra en charge <a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/la-gestion-du-degat-des-eaux-en-copropriete\/la-recherche-de-fuite-cest-quoi\/\"><b>la recherche de la fuite<\/b><\/a>, <b>l\u2019estimation <\/b>du montant des <b>dommages <\/b>et les travaux de remise en <b>\u00e9tat <\/b>ou de <b>r\u00e9novation<\/b>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30402ae9 elementor-widget elementor-widget-heading\" data-id=\"30402ae9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Dans le cas o\u00f9 le d\u00e9g\u00e2t des eaux touche une partie privative<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d6f2ce0 elementor-widget elementor-widget-text-editor\" data-id=\"2d6f2ce0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Si le <b>sinistre <\/b>provoqu\u00e9 par une installation <b>commune <\/b>a provoqu\u00e9 des dommages dans des parties <b>privatives<\/b>, le syndic doit remplir <b><a href=\"https:\/\/www.watio.fr\/guide\/centre-daide\/constat-amiable-de-degat-des-eaux\/comment-remplir-son-constat-de-degat-des-eaux-en-ligne\/\">un constat \u00e0 l\u2019amiable<\/a><\/b> avec chaque occupant <b>l\u00e9s\u00e9<\/b>, puis ajouter ces <b>documents <\/b>au dossier sinistre qu\u2019il transmettra \u00e0 l\u2019assurance de l\u2019immeuble.<\/p>\n<p>Dans certain cas il peut arriver que l\u2019identification de <b>l\u2019origine <\/b>de la fuite soit <b>compliqu\u00e9e<\/b>. C\u2019est souvent le cas lorsque <b>l\u2019infiltration <\/b>provient d\u2019une canalisation <b>cach\u00e9e <\/b>derri\u00e8re un mur. Ce sinistre rel\u00e8ve g\u00e9n\u00e9ralement de la garantie \u00ab\u2009catastrophes naturelles\u2009\u00bb.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2dc1a6e9 elementor-widget elementor-widget-heading\" data-id=\"2dc1a6e9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quel r\u00f4le joue le syndic de copropri\u00e9t\u00e9 en cas d\u00e9g\u00e2t des eaux dans les parties communes\u2009?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-32e992d4 elementor-widget elementor-widget-text-editor\" data-id=\"32e992d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Lorsqu&rsquo;un <b>sinistre <\/b>affecte les parties <b>communes<\/b>, il faut imm\u00e9diatement <b>informer <\/b>le <b>syndic <\/b>de copropri\u00e9t\u00e9. Si possible, il faut <b>pr\u00e9ciser <\/b>la source de la <b>fuite <\/b>et joindre des <b>photos<\/b>.<\/p>\n<p>Le <b>syndic <\/b>demandera <b>l&rsquo;ouverture <\/b>d&rsquo;un dossier de <b>sinistre <\/b>aupr\u00e8s de la compagnie d&rsquo;assurance de <b>l&rsquo;immeuble<\/b>.
